Will of Bartley Debnam

Johnson County, Illinois (Box 55)
In the name of God Amen I Bartley Debnam of the county of Johnson and State of Illinois being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish, and declare this to be y last will and Testament. That is, to say first, after all my lawful debts is paid and discharged the residue of my estate real and personal. I bequeath and dispose of as follows
Towit: To my Beloved wife Sarah Jane Debnam, all my estate real and personal that is not otherwise provided during her natural life or widowhood.
To my sons William Caral, Isaac N., John Henry, and James Robert I give all my real estate equally between them or the surviving ones. If any should die minors at the time the youngest surviving one shall arrive at the age of twenty one years old providing their mother is out of possession of it at that time by either of the reasons above given (death or marriage). If not as soon thereafter as it is vacated by her from the causes above named.
To my daughters Barbary Angalin Wymore and Dorothy Elizabeth Wilson I have given 1 horse – 1 cow and calf – 1 Bed and furniture with other little things as well known to the family as myself. I therefore request that of the proceeds of my personal property my other daughter Lucinda Adaline be made equal with them at the time she may marry or arrive of age in years.
Likewise I make constitute and appoint James W. Bayles to be executor of this my last will and testament hereby revoking all former Wills by me made.
In witness whereof I have here unto subscribed my name and affixed my seal the fifteenth day of February in the year of our Lord One Thousand Eight hundred and Sixty Five.

The above written instrument was subscribed by the said Bartley Debnam in our presence and acknowledged by him to each of us. And he at the same time published and declared the above instrument so subscribed to be his last will and testament, and we at the testators request and in his presence have signed our names as witnesses herto and written opposite our names our respective places of residence.

On this 15th day of May 1865 personally appeared in open court R. D. Hight & W. S. Throgmorton two of the subscribing witnesses to the foregoing last will and testament of Bartley Debnam deceased who after being first duly sworn according to law Deposes and Says on their oaths that they were present and saw the said Bartley Debnam sign his name to the said last will and testament in there presents and in the presents of each other and they believe the said Bartley Debnam was of sound mind and memory at the time of signing the same.
